Appellate Court Declines to Hear Emergency Writ in Yuba Marijuana Case

Sacramento, Friday, April 8th---The 3rd Appellate Court has declined to hear the matter of Powers et al. v. Superior Court of Yuba County which was filed with the Court April 7th in response to the ruling of Superior Court Judge Ben Wirtshafter on April 3rd.

Judge Wirtshafter refused to set aside an urgency declaration which coincided with the passage of Yuba County’s new marijuana cultivation ordinance, thereby denying the complainants the right to submit signatures forcing the ordinance to a voter referendum.
